Failure of the hypothesis ? none applicability. It's just likely the
experiment needs to be designed better... possibly requiring ethical
limits to be removed. Which makes certain things "untestable with
available techniques".

But would you say that theoretical physics is a pseudo-science because
we can't test it properly yet?
