There is no such difference. The authors are under no obligation to 
provide you with the source code if you don't buy their themes. That 
said, once you have the sources there is nothing illegal about, say, 
posting torrents for them on The Pirate Bay for example -- and I would 
be surprised it this has not already happened for all of themeforest's 
content.
