The end is near for SCO (hopefully)



Just a bit more to gloat on, both IBM and Novell filed motions to=20
convert SCO from Chapter 11 to Chapter 7. From IBM's motion Preliminary=20
Statement:

"In the more than 19 months since the Debtors filed these Chapter 11=20
cases, they have squandered cash and have operated at a loss (even=20
excluding reorganization items). They freely admit that they are not=20
likely to have the liquidity to sustain their operations for much=20
longer. The Debtors have failed in every attempt to sell or reorganize=20
the business. They have failed to provide evidence of any viable=20
business and have succeeded only in depleting the limited assets=20
available to satisfy creditors. There is neither a viable business to=20
reorganize nor an advantage to liquidating under Chapter 11. To conserve =

whatever value may still remain in the Debtors' assets, these cases=20
should be converted to cases under Chapter 7".

IMHO, these motions should have been filed earlier, but I think that the =

exclusive period for SCO to seek reorganization had to expire first.  I=20
think much of the motivation from IBM and Novell is to squash the=20
appeal. If the appeals court rules in favor of SCO, then Novell would=20
stand to lose most of its Unix copyrights, and the SCO vs. IBM case=20
would gain some momentum. By moving to Chapter 7, SCO management would=20
immediately be replaced by the trustee who can then make a more=20
independent decision.=20

And again, these cases have an affect on the future of Linux.
